Terms of Service

Welcome to TwiceViral. These Terms of Service ("Terms") govern your access to and use of www.twiceviral.com (the "Service"), operated by TwiceViral ("TwiceViral," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Description of the Service

TwiceViral provides users with pre-made social media content templates. Users select a template and fill in the blanks to create a customized, ready-to-use social media post ("Finished Post"). Access to the Service is provided on a subscription basis as described in Section 5.

3. Accounts

  • You may create an account using an email address and password, or by signing in with Google.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate information when creating your account and to keep it up to date.
  • You must notify us promptly at jointwiceviral@gmail.com if you suspect unauthorized use of your account.

4. Templates: License and Restrictions

4.1 Ownership

All templates available on the Service are owned by TwiceViral and are protected by copyright and other intellectual property laws.

4.2 License Grant

Subject to your compliance with these Terms and an active subscription (where applicable), we grant you a limited, non-exclusive, non-transferable, revocable license to use the templates solely to create your own social media posts ("Finished Posts") for your own personal use.

4.3 Restrictions

You may not:

  • Copy, resell, sublicense, redistribute, or share the templates themselves (in blank or unfilled form) with any other person or entity
  • Use the templates to create a competing product or service
  • Claim ownership of the templates themselves
  • Use the templates for any purpose other than creating your own Finished Posts for your own personal use

This restriction applies to the templates and to the Finished Posts created from them. See Section 5 for restrictions on how you may use your Finished Posts.

5. Your Content

5.1 Use of Finished Posts

The Finished Posts you create using our templates are provided to you for your own personal use only. You may post and share a Finished Post on your own personal or business social media accounts. You may not:

  • Resell, license, or otherwise commercially distribute a Finished Post to any other person or entity
  • Create Finished Posts on behalf of, or for delivery to, a third party (e.g., as a freelance or client service)
  • Use a Finished Post in any way that competes with or replicates our Service

5.2 License to Us

To operate the Service, you grant TwiceViral a limited license to store, host, and process the content you enter into templates and your resulting Finished Posts, solely for the purpose of providing the Service to you (e.g., saving your posts so you can retrieve them later).

5.3 Your Responsibility

You are solely responsible for the Finished Posts you create and publish, including ensuring they comply with applicable laws and the policies of any social media platform on which you post them.

6. Subscription and Billing

  • The Service is offered on a subscription basis. Subscription fees are billed on a recurring basis and automatically renew at the end of each billing cycle unless canceled.
  • Payments are processed by our third-party payment processor, Polar Software, Inc. By subscribing, you agree to Polar's applicable terms and privacy policy governing payment processing.
  • Cancellation: You may cancel your subscription at any time. If you cancel, you will retain access to the Service until the end of your current billing cycle, after which your subscription will not renew and access will end.
  • No refunds: Except as required by applicable law, fees already paid are non-refundable, including for partial billing periods.
  • We reserve the right to change subscription pricing. We will provide reasonable notice of any price changes before they take effect for existing subscribers.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Interfere with or disrupt the operation of the Service
  • Use automated means (bots, scrapers) to access the Service without our prior written consent
  • Use the templates or Service to create content that is unlawful, defamatory, harassing, or infringes on the rights of others

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All content, features, and functionality of the Service, including the templates, design, text, graphics, logos, and software, are owned by TwiceViral or our licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our branding, logos, or trademarks without our prior written consent.

9. Third-Party Services

The Service integrates with third-party services, including Google (for sign-in and analytics) and Polar Software, Inc. (for payment processing). Your use of these integrations is also subject to the applicable third party's terms and privacy policy. We are not responsible for the practices or performance of these third-party services.

10. Termination

  • By you: You may stop using the Service and/or request account deletion at any time by emailing jointwiceviral@gmail.com.
  • By us: We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, or for any other reason at our discretion, including discontinuation of the Service.
  • Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (e.g., Sections 4.3, 5, 8, 11, 12) will continue to apply.

11. Disclaimers

THE SERVICE AND ALL TEMPLATES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY POST CREATED USING OUR TEMPLATES WILL ACHIEVE ANY PARTICULAR RESULT (INCLUDING ENGAGEMENT, REACH, OR "VIRALITY").

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWICEVIRAL AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless TwiceViral and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from your violation of these Terms or your misuse of the Service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
